Booking & Payment Terms
For the purposes of these terms and conditions, ‘the Photographer’ is noted as Aoife Elizabeth Photography
Booking and Payment
A non-refundable deposit of €150 is required to secure your booking. The remaining balance for the session fee is due after the photography session and prior to gallery delivery. This payment must be made within one week post photo session. The session fee covers my time during the session and the creativity of editing work. Printed products are purchased after/separately. No products are delivered (either digital or print) without full payment. A payment link or invoice will be provided by the Photographer for all payments. The Photographer reserves the right to amend prices as appropriate, however the charges agreed at the time of booking will stand.
Voucher values are based on value of shoot at the time of booking. Should the price of packages increase, additional payment may be required to supplement the voucher value.
Once your booking is made and the session deposit fee is received, you will receive a client guide with all the information and tips for your session. If I haven't already done so we will have a quick consultation through phone call or email so I can tailor your session appropriately.
Cancellation and Rescheduling
If you need to cancel the session, please notify me via email or call at least 14 days in advance to avoid losing your deposit. Rescheduling is permitted with at least 7 days’ notice, subject to availability. The Photographer reserves the right to cancel the session due to unforeseen circumstances, in which case a full refund will be provided.
In the event of sickness prior to the session, the client agrees to make every possible effort to inform the Photographer no later than 4 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a 2-month period, if availability allows for the Photographer. If the client fails to reschedule within the 2-month time period, The Photographer has the right to cancel the booking with all payments made non-refundable.
If in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a photo shoot, the Photographer may elect to use an alternate location or to reschedule the photo shoot.
Session Details
Please be on time, if the client is more than 30 min late, the session may be cancelled, and the session fee is non-refundable.
The session will take place at a location and time agreed by both parties at the time of booking. The duration of the session is approximately 1-2 hours unless otherwise agreed upon. Additional time may be scheduled if both parties agree for an agreed fee.
Image Delivery
The Photographer will provide a selection of edited images and will endeavour to do this within 2 weeks after the session. The photographer will notify the client of any delays in this regard.
All images are edited based on the Photographers portfolio at the time of booking. The client booked the Photographer based on the portfolio; it is up to the Photographer on how each session is edited
If the Client elects to purchase additional products / wall art then these incur an additional cost. A viewing session may be scheduled to finalise products. Payment is accepted by payment link on the day. If needed a payment plan can be set up and we can arrange this accordingly. No products will be given until payment is made in full. Delivery of print products will be made by the Photographer within the Dublin area only.
Online galleries will be deleted after 6 months. It is the clients responsibility to ensure images have been downloaded from the gallery
Copyright and Usage
The Photographer retains full copyright to all images produced during the session. The Client receives a non-exclusive license for personal use of the images, including sharing on social media. Commercial use of the images requires prior written consent from the Photographer and may incur additional charges.
Model Release
The Client grants the Photographer permission to use the images for promotional purposes, including but not limited to portfolios, websites, and social media. If the Client does not wish to be included in promotional materials, they can opt out at their own discretion. The client must notify the Photographer of this opt out prior to the photo session.
Liability
The Photographer is not liable for any injuries or damages incurred during the session. The Client is responsible for their own safety and the safety of any minors present during the session.
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the chosen package. Neither party shall be liable for the indirect or consequential loss.
In the event the Photographer is not able to provide services on your scheduled date and time due to fire or other casualties, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, your session will be rescheduled on a date that suits both parties. This would only be if absolutely necessary and is not expected to be a possibility.
If the Photographer cannot perform this contract due to fire or other casualties, strike, act of God or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, The Photographer shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of all monies paid.
In the event of natural disaster or circumstances beyond any party and the photo shoot can not take place at the requested dates. All sessions will be rescheduled to a date and time that will suite both parties. In this case all deposits stay with the Photographer.
The use of mobile phone cameras or other camera devices are not allowed during your session.
Complaints
The parties agree to positive cooperation and communication for the best possible result. The Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the location restrictions.
Complaints should first be raised by the Client with the Photographer in hope to resolve the issue. Complaints should be raised within 3 days of receiving the images.
There will be no changes or refunds to the images, after the pictures have been delivered to the client.
On Location Shoots
The client is responsible for acquiring any and all permits and necessary permission for all locations on which the Photographer will be performing services. The Photographer is limited by the rules and guidelines of the location and site management. The client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the client's responsibility; the Photographer can offer technical recommendations only. If for any reason we are unable to shoot due to permit issues, then the deposit will be retained by The Photographer.
Reshoot
Re-shoots are determined at the discretion of the Photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather-related issues, or by not following the recommendations of the Photographer. If children are not cooperating, the client is welcome to reschedule another shoot for an additional €200 and you will be able to pick the images from both shoots. This must be agreed by both parties on the day of the initial shoot.
Refund
Due to the nature of digital photography and the fact the photographs, once sent, cannot be returned. Once final payment has been completed (i.e. the buyer selected and paid for the photo session and The Photographer sent the buyer the correct photography) it is then considered non-refundable.
Printed products cannot be returned or refunded.
Vouchers are non-refundable. Under no circumstances the value of a voucher will be paid out to the original buyer or the person that holds the voucher.
Agreement
By booking the session, the Client agrees to these terms and conditions. The Client will be provided with a link to these terms and conditions at the time of booking. Introduce your brand
